Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 147, 148, 149, 341, 323, 324, 325, 326, 379 and 354 of the Indian Penal Code, registered in connection with Imamganj P.S.Case No. 24 of 2020. As per allegation, the named accused persons assaulted the informant and his family members. The allegation against the petitioner is that he assaulted Musafir Yadav on his head with an axe.

No.49942 of 2021(3) dt.06-07-2022 2/2 The learned counsel for the petitioner has submitted that there is land dispute between the parties and injuries sustained by Musafir Yadav are simple in nature. The petitioner is a person of clean antecedents and on similar footing co-accused Rajendra Yadav was granted anticipatory bail in Cr.Misc. No. 32681 of 2021.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Sherghati, Gaya in connection with Imamganj P.S.Case No. 24 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
