The petitioner seeks regular bail in connection with Sakatpur P.S. Case No. 63 of 2014 for the offences punishable under Section 363 of the Indian Penal Code.
The allegation against the petitioner herein and one other co-accused person is regarding them having abducted the victim girl and committed rape upon her.
The learned counsel for the petitioner submits that a bare perusal of the statement of the victim girl made under section 164 Cr.P.C. would show that the accused person against whom there is allegation of rape is Ranjan and not the petitioner herein. It is submitted that as far as the Ranjan is concerned the police has submitted final form. The petitioner is stated to be having a
Patna High Court Cr.Misc. No.25360 of 2018 (4) dt.19-06-2018 2/2 clean antecedent and is languishing in custody since 14.03.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Sakatpur P.S. Case No. 63 of 2014.
