The petitioner seeks bail in Sono P.S. Case No. 36/2014, registered for the offences punishable under Sections 364 and 34 of the Indian Penal Code.
The informant alleged that the petitioner and others kidnapped his son.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in the case on account of land dispute. On the next day the son of the informant returned and disclosed the name of the petitioner and two others namely, Yamuna Ravidas and Rahul Kumar Dubey who have been granted bail vide order passed in Cr. Misc. 48045/2014 and 28537/2014 respectively. The case of the petitioner stands on the same footing.
Patna High Court Cr.Misc. No.15783 of 2017 (2) dt.24-04-2017 Prayer for anticipatory bail of the petitioner was earlier rejected by this court. The victim has also named the petitioner along with other accused persons.
Considering the facts aforesaid and the fact that the case of petitioner stands on the same footing as that of Yamuna Rabidas and Rahul Kumar Dubey who have already been granted bail, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Jamui in connection with Sono P.S. Case No. 36/2014.
