The petitioners are apprehending arrest in a case registered for the offences punishable under Section147/148/149/153/153A/323/307/337/353/427 of the Indian Penal Code.
It is alleged that during emersion of Idol of Goddess Saraswati some processionst threw Abir on a person of the Muslim community, thereafter, both sides' pelted stones on each other, as a result, the informant and others received injuries. The mob also tried to cause burn injury to the informant. It is submitted by learned counsel for the petitioners that accusation is omnibus and general against the mob. There is other version also of the occurrence being Nagra (Khaira) P.S.
Patna High Court Cr.Misc. No.25802 of 2015 (2) dt.17-07-2015 2/2 Case No.09 of 2015 in which petitioner is made accused. Apart from the above two cases, the petitioners are not accused in any other case.
Considering the accusation against the mob, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Chapra, Saran in connection with Khaira (Nagra) P.S. Case No.11 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
