The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition & Excise Act.
There is recovery of 3524.580 litres of Indian Made Foreign Liquor from the house of the co-accused persons and from other places. The name of the petitioner surfaced on the confessional statement of co-accused namely Srikant Ray @ Srikant Kumar Ray. He disclosed the name of the petitioner as one of his associates. Considering the fact that petitioner is a habitual offender and he is accused in four other cases, this Court is
Patna High Court CR. MISC. No.40763 of 2022(2) dt.04-11-2022 2/2 not inclined to grant the privilege of anticipatory bail to the petitioner. The prayer for grant of anticipatory bail to the petitioner stands rejected.
Accordingly, the petition is disposed off with a liberty to the petitioner to surrender before learned Court below and pray for regular bail. The learned Court below may consider the prayer for regular bail of the petitioner, keeping in view the facts discussed above and without being prejudiced by the order of this Court.
