2. Petitioner apprehends arrest in a case registered for the offence punishable under section 356 and 379 of IPC.
3. The prosecution case, in brief, is that on September 9, 2022, in the afternoon, while the informant, Brajesh Kumar Chauhan, was riding a Scooty along with his wife, a motorcycle bearing registration number BR-01DY9264 (or BR-01BY9264) carrying three riders overtook them and snatched the informant's mobile phone from the pocket of his shirt. Accordingly, the FIR was lodged.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this
Patna High Court CR. MISC. No.39240 of 2026(2) dt.23-06-2026 2/2 case only because the motor-cycle in question belongs to him. Only suspicion has been raised against this petitioner. No stolen articles were recovered from the possession of this petitioner from his home.
5. Learned counsel for the State opposed the prayer for bail and submitted that during investigation it has come that the motor-cycle bearing BR-01BY9264 belongs to this petitioner and he has got one criminal antecedent.
6. Considering the nature of accusation, criminal antecedent of this petitioner and other circumstances of the case, prayer for pre-arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Koushik/Alok RajU T
