The petitioner seeks regular bail in connection with Ahiyapur P.S. Case No. 565 of 2017 for the offences punishable under Section 364(A)/34 of the Indian Penal Code. The allegation is regarding the accused persons having kidnapped the victim boy and the police is said to have recovered the victim boy and the petitioner was caught red handed from the place where the police has conducted raid. The learned counsel for the petitioner submits that the petitioner has not been made accused in the present case and has been merely remanded in the present case and he is languishing in custody since 19.09.2017.
I have heard the learned counsel for the parties and
Patna High Court Cr.Misc. No.26210 of 2018 (4) dt.05-07-2018 2/2 on perusal of the case diary I find that there are ample material to proceed against the petitioner. Moreover, the petitioner is a veteran criminal inasmuch as he is an accused in three other cases, hence it is not in the interest of society to enlarge him on regular bail. Accordingly, the prayer of the petitioner for grant of regular bail is rejected.
At this stage the learned counsel for the petitioner submits that he may be granted liberty to renew prayer for bail after a specified time period. The petitioner may do so if the Trial is not concluded within a period of two and half years from today. (Mohit Kumar Shah, J) BTiwary/-Md Rashid U T
