The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 149, 188, 269, 270, 271, 323, 353 and 307 of the Indian Penal Code and Section 3 of the Epidemic Act and Section 57 of the Indian Disaster Management Act.
The informant alleges that during lock-down, he saw shop opened and some customers were present and they abused and assaulted the police when they asked them to follow lockdown rules. Learned counsel for the petitioner submits that the petitioner has antecedent of three cases. Learned counsel further
Patna High Court CR. MISC. No.40426 of 2022(2) dt.08-12-2022 2/2 submits that the petitioner has been falsely implicated in the present case, it is next submitted that the allegations are general and omnibus in nature, it is also submitted that petitioner had gone to purchase something since the shop was opened as during lock-down, it was difficult to buy goods and household articles.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Birpur P.S. Case No. 70 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
