====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 20-09-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case instituted under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code. The allegation against the petitioner that he in collusion with other co-accused got forged registry of their land. It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.06.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The entire matter relates to sale and purchase of land. The petitioner claimed to be the genuine purchaser of the land. Civil Proceedings are

Patna High Court Cr.Misc. No.32484 of 2016 (3) dt.20-09-2016 2/2 already pending in the court below. The genuineness of the sale deed can only be looked into by competent court. Other coaccused has been granted bail vide Annexure-2 to the present application.

On behalf of the state and the counsel for the informant, it has been submitted that the petitioner is named in the F.I.R. and by way of fraud, the land in question has been purchased by them.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhabua (Kaimur), in connection with Bhabua P.S. Case No. 55 of 2014.
