The petitioner is accused in connection with Special Case No. 22 of 2016, arising out of Araria (R.S.) P.S. Case No. 350 of 2016, registered under Sections 272 and 273/34 of the Indian Penal Code, Sections 27(b)ii/28 of the Drugs and Cosmetic Act and Sections 22 and 25 of the N.D.P.S. Act. The accusation is that the informant being the Drug Inspector, Araria, received information about accident of the Scorpio vehicle on N.H. 57 near Hadiyabara, on which, Codeine Phosphate were loaded. Thereinafter, he reached there and in presence of officer-in-charge, Araria Police Station, the vehicle was searched then 1100 bottles each containing 100 ml of ParvoCof and 710 bottles each containing 100- ml of Corex were
Patna High Court Cr.Misc. No.3403 of 2017 (2) dt.10-02-2017 recovered. In course of investigation, it has come that this petitioner was the driver of the said vehicle. Learned counsel for the petitioner submits that petitioner has no criminal antecedent and is in custody since 01.10.2016.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Araria in connection with Special Case No. 22 of 2016 arising out of Araria (R.S.) P.S. Case No. 350 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
