Petitioner, already in custody, seeks bail in connection with Sohsarai PS Case No.99 of 2017 registered under Sections 420 and 406 of the Indian Penal Code as well as under Section 138 of the N.I. Act.

Allegation in brief is that the petitioner had taken loan of Rs.12,00,000/- in four installments from the informant with promise to return back and issued cheque but it got dishonoured as account of the petitioner was found closed. Learned counsel for the petitioner submits that it is not a case of cheating, the account of the petitioner was closed later on and the petitioner has no criminal antecedent and has been

Patna High Court Cr.Misc. No.28986 of 2018(3) dt.18-06-2018 2/2 in custody since 02.12.2017.

Having considered the aforesaid facts and circumstances, petitioner Sunil Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-VII, Nalanda at Biharsharif in connection with Sohsarai PS Case No.99 of 2017.
