The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Excise Amendment Act, 2016.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in this case.

There is no recovery from the conscious possession of the petitioner. There is no compliance of Section 100 Cr.P.C. In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks

Patna High Court CR. MISC. No.36503 of 2019(4) dt.14-08-2019 2/2 from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Nawada Town P.S. Case No. 247 of 2019 to the satisfaction of the learned A.D.J.-II cum Special Judge, Nawada, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
