The petitioners apprehend their arrest in Ratanpura P.S. Case No. 51/2014, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
The informant named seven persons in the F.I.R. and alleged that they all came to his field and Pramod Mehta fired causing the death of Ramnandan Yadav.
It is submitted that the petitioners are not named in the F.I.R. There is no allegation against the petitioners, but from perusal of order impugned it appears that name of the petitioners has come during the course of investigation.
Patna High Court Cr.Misc. No.29834 of 2016 (3) dt.21-09-2016 2/2 Learned counsel for the informant submits that petitioners have already been declared absconder and their properties have also been attached.
Considering the facts aforesaid, I am not inclined to enlarge the petitioners above-named on anticipatory bail. Accordingly, the same is rejected.
