JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 272, 273 of the Indian Penal Code and 47(a) of Bihar Excise Act.

Near about 30 litres country made liquor are said to have been recovered near the State Boring and prosecution claims that petitioner with the help of one Ramnath Singh was preparing illegal country made liquor. Admittedly, neither petitioner was caught on the spot nor anything was recovered from his conscious possession and it was co-accused Ramnath Singh who disclosed before the police that petitioner was also involved in manufacturing country made liquor illegally.

Moreover,

Patna High Court Cr.Misc. No.30029 of 2016 (2) dt.29-07-2016 2/2 investigation against the petitioner has already been completed. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Dehri, District Rohtas in connection with Rohtas P.S. Case No.52 of 2016.
