JUSTICE SATYAVRAT VERMA ORAL ORDER 02-02-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. Learned counsel for the petitioner submits that a supplementary affidavit has been filed rectifying the pleadings made in paragraph '1' of the bail application. The petitioner seeks bail in connection with Bhagwanpur P.S. Case No. 92 of 2021 instituted for the offences under Sections 304B and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 11.04.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that informant alleges that his daughter was married to one Vikash Rai five years ago and due to non-fulfillment of dowry demand

Patna High Court CR. MISC. No.49475 of 2021(3) dt.02-02-2022 2/2 of Rs. 4 lakhs, his daughter was killed by forcibly administering poison.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated along with her husband when they don't stay together with their son, further it is submitted that informant is not an eye-witness to the occurrence, the husband of the deceased is in custody and the petitioner is the mother-in-law of the deceased.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 11.04.2021, charge-sheet has been submitted in the case petitioner is a person with clean antecedent, is mother-in-law of the deceased and the husband of the deceased is in custody, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 92 of 2021.
