01-07-2015 The grievance of the petitioner has been redressed but one pin-prick remains. The petitioner had retired while officiating as a Head Clerk from the Bihar State Board of Homoeopathic Medicines (for short the 'Board') on 30.11.1991. There was an audit objection. It was in 1989-90 and 1990-1991, whereby it was held out that petitioner should continue substantially on the post of Accountant and not Head Clerk. After superannuation petitioner's dues are all being settled as an Accountant, but, as per Annexure - 2 to this application, the Audit objection already stands resolved and dropped. The status of the petitioner as Head Clerk at the time of his
Patna High Court MJC No.2466 of 2009 (9) dt.01-07-2015 superannuation is restored. Now that the audit objection stands dropped he would now be deemed to have retired as Head Clerk-cum-Accountant and his last pay drawn would be that accordingly.
Let Registrar-cum-Chairman of the Bihar State Board of Homoeopathic Medicines, Patna, examine this aspect of the matter and take necessary decision within one month from today and communicate the same to the petitioner in writing giving reasons for its order. In case it is found that petitioner is entitled to any additional remunerations, the same would be worked out and paid to the petitioner within a period of three months.
With the above observations, this application stands disposed of.
