JUSTICE SUDHIR SINGH ORAL ORDER 21-05-2015 The petitioner is apprehending his arrest in connection with Excise Case No. 37 of 2014 for the offence under Section 47(a) of the Excise Act.

Heard learned counsel for the petitioner and the State.

The prosecution story, in brief, is that this is a case of recovery and seizure of 54 liters country made illicit liquor from the house of the petitioner.

It is submitted on behalf of the petitioner that petitioner has not been apprehended on the spot. Further, it has been submitted that the petitioner has falsely been implicated in the present case. The petitioner has further submitted that he shall deposit an amount of Rs. 20,000/- in the leaned court below which may be subject to the final disposal of the case.

Patna High Court Cr.Misc. No.12934 of 2015 (2) dt.21-05-2015 On behalf of the State, it has been submitted that the petitioner is named in the First Information Report. Considering the aforesaid facts that the petitioner is directed to deposit an amount of Rs. 20,000/- in the leaned court below which shall be subject to the final disposal of the case, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of eight weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Saran at Chapra in connection with Excise Case No. 37 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
