JUSTICE SUDHIR SINGH ORAL ORDER 05-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 363 and 366(A) of the I.P.C. The prosecution story, in brief, is that on 4.12.2015 at 4 P.M. the informant's adopted daughter, namely, Shalini Kumari was going to the Coaching Center of the petitioner for studying but she did not return back even at 8 P.M. and then the informant started searching her. Thereafter informant went to the Coaching Center and asked about the petitioner, the family members of the petitioner declined to extend any co-operation and share any information.
Then the informant made queries from the people of the locality and was informed that his adopted daughter was spotted with the petitioner proceeding towards Hajipur. The informant suspected that his adopted daughter has been kidnapped by the petitioner in connivance with their parents.

No.29152 of 2016 (3) dt.05-09-2016 2/2 It has been submitted on behalf of the petitioner that the petitioner is in custody since 5.1.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The alleged date of occurrence is 4.12.2015 and the F.I.R. has been instituted on 13.12.2015. Delay has not been explained by the prosecution. The victim girl has alleged in her statement recorded under Section 164 Cr.P.C. that she travelled on train with the petitioner to Surat, Agra and Goraul, where they were married. The age of the victim girl is assessed to be 18 years. There was admitted love affairs between the petitioner and the victim girl.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Hajipur, Vaishali in connection with Biddupur P.S. case No.519 of 2015.
