JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-03-2020 Heard learned counsel for the petitioner. No one appears for the opposite party no.2 on repeated calls. Same was the position on the previous date also.
Petitioner apprehends arrest in a case registered for the offences punishable under Sections 498A/379 and other allied sections of the Indian Penal Code and under sections 3⁄4 of the Dowry Prohibition Act.
Learned counsel for the petitioner, while referring to paragraph 12 of the bail petition, submits that the petitioner is ready to keep opposite party no.2 at this house with full dignity and honour.
Considering the aforesaid submission, let the petitioner, above named, in the event of surrender before the
Patna High Court CR. MISC. No.35999 of 2019(7) dt.02-03-2020 2/2 Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in Complaint Case No. 2861C/2017, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
It is made clear that if the petitioner fails to abide by aforesaid undertaking, opposite party no.2 would be at liberty to approach the Court below for cancellation of bail. (Prabhat Kumar Singh, J) Shashi U T
