JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 15-02-2022 Heard both the parties through video conferencing. Learned counsel for the petitioner submits that the petitioner no.2 is arrested, hence he prays to withdraw his bail application.

Prayer allowed.

The bail application of the petitioner no.2 is dismissed as withdrawn.

The petitioner seek bail in anticipation of his arrest in connection with Basopatti P.S. Case No.164 of 2021 instituted for the offences under Sections 272, 273, 34 of the Indian Penal Code & Section 30(a) of Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.49787 of 2021(2) dt.15-02-2022 2/2 recovery has been made from the other house. He is not involved in any manner in this case.

Taking into consideration the aforesaid fact, I am inclined to grant benefit of anticipatory bail to the petitioner to the petitioner no.1 and in the event of arrest, he shall be released on bail subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
