JUSTICE SHAILENDRA SINGH ORAL ORDER 03-09-2025 The petitioner apprehends his arrest in connection with Complaint Case No. 2916/ 2022 registered for the offence(s) punishable under Section(s) 498(A), 379 and 323 read with section 34 of the IPC and the cognizance has been taken under sections 498(A) and 323 of the IPC.
2. Heard Mr. Hemant Ray, learned counsel for the petitioner and Mr. Kanhaiya Kishore, learned APP for the State and perused the complaint petition filed by the O.P. No.2, who happens to be wife of the petitioner.
3. Though, the complainant has made allegation of cruelty for demand of dowry committed with her by the petitioner, however, considering the aspect that there is no

No.39157 of 2025(3) dt.03-09-2025 2/2 evidence of physical cruelty and further, the judicial custody of the petitioner will adversely affect the possibility of re-union of the spouses, in my opinion, it is a fit case for grant of anticipatory bail to the petitioner. Accordingly, let the petitioner named-above, in the event of his arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with Complaint Case No. 2916/ 2022 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned, subject to the conditions as laid down under Section 482(2) of the Cr.P.C.
