The petitioner apprehends arrest in a case registered for the offence punishable under sections 414, 401/120B of the Indian Penal Code and sections 25(1-B)a, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner's name has figured during course of investigation in confessional statement of co-accused who was apprehended with arms and ammunition. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid

Patna High Court CR. MISC. No.40847 of 2022(2) dt.28-11-2022 2/2 recovery. Petitioner has got no criminal antecedent. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in Surajgaraha Police Station Case No. 37 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
