04-04-2016 Heard learned counsel for the petitioner and Sri Sharad Kumar Sinha, learned Govt. Pleader - 15. In the present writ petition, the petitioner, invoking writ jurisdiction of this Court under Article 226 of the Constitution of India, has made a prayer for directing the respondents for properly fixing his pay.

It has been claimed that the petitioner is entitled to get total pay of Rs. 19,456/-. A plea has been taken that though the petitioner retired in the year 2008, in 2010, due to some clerical

Immediately thereafter, the petitioner filed a detailed representation before the Executive Engineer, Irrigation (Mechanical) Division, Samastipur. He submits that during the pendency of the writ petition, the said Division has been shifted as Sub-Divisional Irrigation Department, Banka. Accordingly, he makes a prayer for disposal of the present writ petition with liberty to file a detailed fresh representation before the competent authority.

In view of submission made by learned counsel for the petitioner, the Court proposes to dispose of the writ petition granting liberty to the petitioner to file a detailed representation before the competent authority. If such representation is filed within a period of eight weeks from today, the Court expects that the authority concerned may examine the same and pass appropriate order in accordance with law, preferably within a period of three months from the date of filing of such representation.

The writ petition stands disposed of.
