The petitioners have prayed for regular bail in a case registered for the offence punishable under Sections 8/20/22 of the N.D.P.S. Act As per prosecution, 4.100 Kg. of green Ganja plants were recovered from the house of the petitioners. Learned counsel for the petitioners submit that the petitioners have got no criminal antecedent. He further submits that Ganja plant was recovered from behind the house of the petitioners. He further submits that small quantity of green Ganja plant has been recovered which is not commercial

Patna High Court CR. MISC. No.41120 of 2022(3) dt.13-02-2023 2/2 quantity. Petitioners are in custody since 12.06.2022. Learned APP appearing for the State has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Narhat (Sitamarhi) P.S. Case No. 406 of 2021, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned court, D.J., Nawada.
