JUSTICE SANJAY PRIYA ORAL JUDGMENT Date: 23-03-2018 This application under Section 482 of the Code of Criminal Procedure has been filed for quashing entire criminal proceeding of Begusarai Town P.S. Case No.197 of 2007 instituted for the offence under Section(s) 341, 323, 504 Indian Penal Code. Counsel for the petitioner has submitted that case is pending in the Court below since long time.
Notice was issued to the Opposite Party No.2, but none has appeared on behalf of the Opposite Party No.2 even after service of notice.
A report was called for from the Court below with regard to present stage of the case, which has been received. The
Patna High Court Cr.Misc. No.51187 of 2014 dt.23-03-2018 2/2 Court below has mentioned in the report that the case is pending for evidence and the next date fixed in the case is 09.12.2017. In such circumstances, this application is disposed off with direction to the Court below i.e. Additional Chief Judicial Magistrate, I, Begusarai, to proceed with the trial in accordance with law and make all efforts to dispose of the same as early as possible preferably within a period of six months from the date of receipt of copy of this order.
