The petitioner seeks bail in connection with Bihar P.S. Case No. 428 of 2020, dated 03.07.2020, instituted for the offences under Sections 353 and 504 of the Indian Penal Code, Section 37(b) (c) of the Bihar Prohibition and Excise (Amendment) Act, 2018 and Sections 25(1-b) and 26 of the Arms Act.

From the F.I.R., it appears that only two live cartridges have been recovered from the possession of the

Patna High Court CR. MISC. No.36727 of 2020(2) dt.01-02-2021 2/2 petitioner.

The petitioner is stated to be in custody since 04.07.2020.

Apart from this, it can be gleaned from the bail application that the petitioner was earlier made accused in about three cases, but he is on bail on those cases. Regard being had to the nature of accusation and the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Addl.
