JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 11-05-2016 Heard the counsel for the petitioner as well as the counsel for the respondent who represents O.P. No. 5 & 6. A show cause in this case is filed on 09.05.2016. The contempt application raises a grievance about willful/deliberate disobedience of the order dated 18.02.2015 passed in C.W.J.C.

Patna High Court MJC No.1337 of 2015 (4) dt.11-05-2016 2/2 No. 2789 of 2015 (Annexure-1), at the hands of the opposite parties particularly the Executive Officer of the Nagar Parishad. Along with show cause a reasoned order dated 07.05.2016 is enclosed which was passed by the Executive Officer of the Nagar Parishad disposing of representation of the petitioner without granting any relief on the plea that a serious dispute of title between the parties in respect of the subject land exists.

The counsel for the petitioner made submissions to challenge the legality/veracity of the said order. Regrettably, the correctness of the order passed by the opposite party in compliance of the order of this Court cannot be considered in contempt jurisdiction.

The petitioner, if so advised, may ventilate his grievance before appropriate Forum/Authority in accordance with law.

The contempt application is dismissed.
