The petitioner is in custody in connection with Sangrampur P.S. Case No. 198 of 2021 for the offence under Sections 302 and 307/34 of the Indian Penal Code lodged on 10.08.2021 by the informant, Shubhash Sharma. As per the prosecution story, the informant alongwith his family members were working in the agricultural field when it is alleged that accused persons variously armed threatened and later assaulted.

Specific allegation against the petitioner is of assaulting Kripali Sharma, the brother of the informant by 'Khanti' which pierce his head.

Subsequently, during course of treatment, he died in

Patna High Court CR. MISC. No.40475 of 2023(2) dt.21-07-2023 2/2 Jawahar Lal Nehru Medical College and Hospital, Bhagalpur. Considering the kind of allegation that has come against the petitioner, this Court is not inclined to grant him the privilege of bail, which is accordingly rejected.
