JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 07-05-2015 Heard learned counsel for the petitioner as well as learned counsel for the State.

In this application for anticipatory bail the petitioner apprehends his arrest for the offences punishable under sections 406, 409, 419 and 420 of the I.P.C.

Allegedly, the petitioner being Panchayat Secretary of Gram Panchayat Raj Haripatti along with Mukhiya committed irregularities in distribution of amount of Suraksha Pension Yojna and in spite of providing full amount they were paying less amount.

Submission is of false implication and that pension amount were paid to the beneficiaries through Bank account and

Patna High Court Cr.Misc. No.50565 of 2014 (2) dt.07-05-2015 2/2 there is no misappropriation of the pension amount, to which the learned A.P.P. opposes.

Considering that there is only allegation of committing irregularities, no beneficiaries have come forward to allege against the petitioner and as such the petitioner in case of his arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Darbhanga in Bahadurpur P.S. Case No. 306 of 2013/ G.R. No. 3113 of 2013, subject to the conditions as laid down in section 438

(2) of the Cr.P.C.
