JUSTICE RAVI RANJAN ORAL ORDER 12-07-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offence punishable under Sections 47 (a) (g)/53 of the Excise Amendment Act.

There is recovery of 48 liters of foreign liquor from Maruti Zen Car which was being boarded by three persons including the petitioner.

It is contended that there is no recovery from the conscious possession of the petitioner and he does not have any connection with the alleged recovery. It is urged that the petitioner is in custody since 2.05.2016 having clean antecedent. Considering the facts and circumstances of the case, the petitioner, namely, Dewanand Kumar @ Dewanand Kuar is

Patna High Court Cr.Misc. No.26550 of 2016 (2) dt.12-07-2016 2/2 directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Dehri, Rohtas at Sasaram in connection with Rohtas P.S. Case No.90 of 2016.

However, it is made clear that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
