The Petitioner seeks bail in Gopalpur P.S. Case No. 123 of 2016 instituted for the offence under Section(s) 414 of the Indian Penal Code and Sections 20, 22, 23, 27A, 29/24 of the Narcotic Drugs & Psychotropic Substances Act. It is alleged that from the roof of the bus, two bags containing 300 pieces each of 25 grams and 120 pieces each containing 9 grams of Nepali Fair & Lovely and 11⁄2 kg ganja were recovered kept in a separate bag. It is alleged in the written report that this lady who was also travelling in the bus, claimed the aforesaid articles belonging to her. The seizure list annexed with Annexure-2 suggests that copy of the seizure list has been given to

Patna High Court Cr.Misc. No.11555 of 2017 (2) dt.23-03-2017 2/2 one Anil Kumar Pandey.

It appears from the written report that petitioner was present at the time of raid but copy of the seizure list was not handed over to the petitioner although it is alleged that petitioner claimed those articles belonging to her.

The petitioner is lady and she is in custody since 11.12.2016.

It has been mentioned in para 3 of the petition that petitioner has clean antecedent.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, West Champaran at Bettiah in connection with Gopalpur P.S. Case No. 123 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
