The petitioner is concerned with the conveyance initiated by the Circle Officer, Udwantnagar, District- Bhojpur on the land of Mauza Pakriyabar, Thana no. 233, CircleUdwantnagar, District- Bhojpur without permission from the Consolidation Office. The registration of the conveyance deeds can be only after the permission is obtained from the
Patna High Court CWJC No.10057 of 2024 dt.01-08-2024 2/3 Consolidation Office, is the argument.
2. The learned Counsel also specifically points to the order of this Court in CWJC No. 161 of 2002 and CWJC No. 12076 of 2001 wherein the Director, Consolidation has been asked to decide afresh the dispute between the parties as raised in both these writ petitions. The writ petition itself was disposed of.
3. We have to observe that the writ petitions disposed of in the year 2012 was filed by private parties who had approached this Court. Any person who is aggrieved with the consolidation proceedings initiated against his or her lands and the registration carried out without permission would be entitled to come to this Court.
4. We find absolutely no reason to entertain the Public Interest Litigation which, we are of the opinion is more of a publicity induced litigation.
5. We dismiss the same with Rs. 5000/- cost payable to the Bihar State Legal Services Authority. The said amount will have to be paid within a period of two weeks, failing which the Bihar State Legal Services Authority will be entitled to proceed for recovery by taking measures similar to recovery of arrears due on land through the District Magistrate, in which
Patna High Court CWJC No.10057 of 2024 dt.01-08-2024 3/3 event the petitioner shall also be liable for the charges incurred for making such recovery, which have to be recovered by the State.
6. Let a copy of this judgment be transmitted to the Member Secretary, Bihar State Legal Services Authority.
