JUSTICE SANJAY PRIYA ORAL ORDER 01-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Rupaspur P.S. Case No. 12 of 2016 instituted for the offence under Sections 394, 397, 307, 411 of the Indian Penal Code and Section 27 of the Arms Act.

Earlier, report was called for from the court below which has been received and kept at Flag 'X'. The court below has stated that charge has been framed and one witness has already been examined. The trial is expected to be concluded within six months.

In such circumstances, this Court is not inclined to grant bail to the petitioner at this stage.

Patna High Court Cr.Misc. No.9380 of 2017 (4) dt.01-05-2017 2/2 Prayer for bail of the petitioner stands rejected. Petitioner may renew his prayer for bail after six months in the lower court itself in the event the trial is not concluded, which shall be disposed off by the court below in accordance with law without being prejudiced by this order.
