The petitioner is in custody in a case registered for the offence punishable under Sections 366A/34 of the Indian Penal Code.

Allegedly, it is a case of dowry death due to nonfulfilment of dowry demand. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that the deceased died due to committing suicide. He further submits that the marriage of the deceased performed in the year 2015 and blessed with three children. There is no consistent evidence that the petitioner had demanded dowry,

Patna High Court CR. MISC. No.41179 of 2022(3) dt.10-01-2023 2/2 harassed and misbehaved with the deceased due to nonfulfilment of said dowry demand and the cause of death is asphyxia due to hanging. Petitioner is in custody since 05.02.2022.

Learned APP appearing for the State has opposed the prayer for regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Sikarahna at Dhaka, East Champaran in connection with Ghorasahan (Jharokhar) P.S. Case No. 56 of 2022.
