JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.
One person died in an accident resulting assemblage of crowd in which petitioner was also present. The aforesaid crowd became furious and started assaulting the officials and it is said that petitioner assaulted Pradeep Kumar Sinha, Officer in charge, Gurua. The injury report of injured, Pradeep Kumar Sinha goes to show that he sustained injury and opinion regarding head injury was kept reserved till receipt of C.T. scan report but it is surprising enough that investigating officer submitted charge sheet
Patna High Court Cr.Misc. No.33845 of 2016 (3) dt.22-10-2016 2/2 without obtaining C.T. Scan report and, therefore, in the aforesaid circumstance, it appears to me that the concerned Officer in charge sustained simple injury. Moreover, having more or less similar allegation, several co-accused have already been granted privilege of bail.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Sherghati, Gaya in connection with Gurua P.S. Case No. 48 of 2016.
