Petitioners seek bail in a case registered for the offence punishable under Section 395 of the Indian Penal Code. Some unknown person allegedly robbed to the informant. The FIR was initially lodged against unknown. Thereafter petitioner Arvind Kewat was arrested by the police
Patna High Court Cr.Misc. No.14200 of 2018 (5) dt.25-04-2018 2/2 abruptly without any material and Arvind Kewat confessed before the police of his involvement in the crime as well as involvement of the petitioner Pappu Kewat. Thereafter from possession of Pappu Kewat a mobile was recovered which Pappu Kewat claims to be his own.
Submission is that neither the petitioners were ever put on TI Parade nor the recovered articles were put on TI Parade. Petitioners are in custody since 15.09.2017. Investigation of the case is already complete. Petitioners are ready to cooperate with the trial.
Considering the aforesaid fact, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Chandi Police Station Case No. 111 of 2017, subject to the condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
