Public Prosecutor for the State assisted by learned counsel for the informant.
Petitioners seek bail in a case registered under section 302 and other minor sections of the Indian Penal Code. Petitioners are named in the first information report but specific allegation of giving rod to the deceased has been levelled against co- accused Tushar Chaudhary and Manoj Chaudhary and so far as petitioners are concerned, omnibus allegation of assault has been levelled against them.
The impugned order of the learned Sessions Judge goes to show that deceased sustained fatal injury on his head and according to the FIR itself, the aforesaid injury of deceased is attributed to coaccused Tushar Chaudhary and Manoj Chaudhary.
Patna High Court Cr.Misc. No.34430 of 2016 (2) dt.23-08-2016 Moreover, petitioners do not have any criminal antecedent and are languishing in jail custody since 1.4.2016. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in Roh P.S. Case no. 20/2016.
