JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-09-2019 This is an application for grant of anticipatory bail in connection with Piri Bazar P. S. Case No. 37 of 2019, disclosing offences under Sections 363, 366A, 379, 34 of the Indian Penal Code.
Allegation against the petitioners, who happens to be the father, mother and brother of one Pranav Kumar of kidnapping the minor daughter of the informant. Submission of the learned counsel for the petitioners is that the F.I.R. itself shows that there was love affair between informant and one Pranav Kumar and allegation is also that she fled away along with Pranav Kumar and petitioner no.3. So far as petitioners no.1 and 2 are concerned, there is only allegation that they are also absconding.

No.36403 of 2019(4) dt.18-09-2019 2/3 Heard learned A.P.P. as well as learned counsel for the opposite party no.2 also, they have opposed the prayer for anticipatory bail by stating that all the accused persons including the petitioners conspires in kidnapping the minor daughter of the informant in order to marry her. Having heard both sides, considering the above submissions, so far as, petitioners no.1 and 2 are concerned, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned S.D.J.M. Lakhisarai, in connection with Piri Bazar P. S. Case No.
37 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. So far as, petitioner no.3 is concerned, considering the fact that the girl is still traceless and there is specific allegation that she was taken by the petitioner no.3 and one Pranav Kumar, I am not inclined to grant privilege of anticipatory bail to him. Accordingly, this application is disposed of.
