JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-01-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341,323,354A and 504/34 of the Indian Penal Code and sections 3(1)(x) and (xi) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
It is alleged that the accused persons took away the paddy crop of the informant. When the informant went to the land in question then petitioner no. 1 caught hold of her and abused by calling the caste name. It is further alleged that when the husband of the informant came to rescue then all the accused persons abused him.
It is submitted by learned counsel for the petitioners
Patna High Court Cr.Misc. No.52110 of 2014 (2) dt.06-01-2015 2/2 that in the background of the land dispute the accusation has been levelled. Earlier also, the informant filed a case with similar accusation in 2006 which was found false during investigation. Considering the nature of accusation, it is a case for consideration of regular bail of the petitioners by the learned court below in case the petitioners surrender within six weeks from today in connection with SC/ST P.S. Case No. 84 of 2013 pending in the court of learned SDJM, Bhojpur at Ara This application is disposed of with the aforesaid observation/direction.
