2. The petitioner is named in the F.I.R. and apprehending his arrest in connection with Industrial Area P.S. Case No. 166/2025 registered for the offences punishable under Sections 319(2) and 336(3) of the BNS and Section 4 of the Bihar Conduct of Examination, 1981.
3. The allegation against the petitioner is to impersonated by some Prakash Chandra @ Rohit son of Kamla Kant Roy in STET Examination.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is innocent and due to his illness he was resting in his house on the date of examination, but his own brother namely, Prakash Chandra @ Rohit went to the examination center and appeared in place of petitioner. Petitioner claimed clean antecedent.

Learned APP while opposing the prayer of bail submitted that petitioner is own brother of co-accused, who impersonated petitioner in the examination and, therefore, it can be safely presumed that petitioner was well aware about the act of co-accused, who appeared in STET examination in his place. It is submitted that this type of instance is very frequent and, therefore, be dealt with rigid approach.
6. In view of aforesaid factual submission and by taking note of fact as the act of co-accused qua impersonation is prima-facie, well within the knowledge of petitioner, accordingly prayer of anticipatory bail of petitioner stands rejected. (Chandra Shekhar Jha, J) S.Tripathi/- U T
