The petitioner seeks regular bail in registered for the offences punishable under section and other allied sections of the Indian Penal Code.

As per the prosecution case, petitioner and coaccused Jhunnu Pandey fired upon Subodh Pandey with country made pistol causing injuries on his neck and head causing his death on the spot.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to land dispute. There is no eye witness of the occurrence. Petitioner is in custody since 15.11.2019. Learned counsel for the State opposes the prayer for

No.50626 of 2021(6) dt.29-03-2022 2/2 bail and submits that there is direct and specific allegation against the petitioner petitioner that he and co-accused Jhunnu Pandey fired upon Subodh Pandey with country made pistol causing injuries on his neck and head causing his death on the spot. Said fact has also been supported by the post mortem report.

Considering the nature of accusation and materials available on the records against the petitioner, his prayer for bail is refused.
