2. The petitioner seeks regular bail in connection with Jamui Mahila P.S. Case No. 65 of 2024 registered for the offence under Sections 64(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 4 of the POCSO Act.

3. As per the prosecution case, the petitioner is accused of committing rape with the victim.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 30.04.2025.

5. Learned A.P.P. for the State as well as the learned

6. Though the petitioner is accused of committing rape with the victim but from the statement of the victim girl recorded under Section 183 of the BNSS, it appears that the petitioner and the victim were in relationship.

7. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned concerned Court below, Jamui in connection with Jamui Mahila P.S.
