ANJANA MISHRA ORAL ORDER 20-04-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the opposite party No. 2 as well as learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 498-A of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

It is submitted on behalf of the petitioner that the petitioner and opposite party No. 2 have now decided to part ways and that there is no dispute existing as on date.

The opposite party No. 2 is present in Chambers before me pursuant to order dated 11.04.2016 also submits that she had decided to live separately from the petitioner and she is not

Patna High Court Cr.Misc. No.4945 of 2015 (6) dt.20-04-2016 P2/2 interested in carrying forward any litigation against the petitioner. In view of the submission made by opposite party No. 2 before this Court and also in view of the supplementary affidavit filed in which Annexure-4 dated 18.01.2016 clearly indicates that a settlement has been arrived at between the parties, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Arrah, Bhojpur in connection with Ara Muffasil P.S. Case No. 143 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
