JUSTICE BIRENDRA KUMAR ORAL ORDER 18-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Section 379 of the Indian Penal Code and later on Section 411 of the Indian Penal Code was also added. The FIR of theft of motorcycle is against unknown. The same was recovered from the possession of co-accused and in the confessional statement name of the petitioner has transpired. The petitioner has disclosed his criminal antecedent in paragraph 3 of the bail petition. Copies of the cases mentioned in paragraph 3 of the bail petition have been produced which would reveal that the petitioner is not named in most of the cases. The petitioner is in custody since 25.10.2016.

Patna High Court Cr.Misc. No.9134 of 2017 (4) dt.18-04-2017 Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria/Successor Court, in connection with Araria P.S. Case No.610 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
