JUSTICE BIRENDRA KUMAR ORAL ORDER 20-06-2018 Heard learned counsel for the petitioner and the State. This is the second attempt of the petitioner for bail. Earlier prayer for bail of the petitioner was refused on 04.01.2018 in Cr. Misc. No. 54112 of 2017.

Allegation against the petitioner is of commission of rape against the minor daughter of the informant. The report of the trial Judge vide his letter dated 18th May, 2018 reveals that three prosecution witnesses have been examined up-till-now.

Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail in connection with Mahila P.S. Case No. 130 of 2017 pending in the court of learned 1st Additional Sessions Judge-cum-Special Court, POCSO Act, Nalanda at Bihar Sharif.

Patna High Court Cr.Misc. No.27288 of 2018 (3) dt.20-06-2018 2/2 Hence, prayer for bail is refused.

Learned trial court is directed to expedite and conclude the trial preferably within a period of nine months from the date of receipt/production of a copy of this order, failing which the petitioner would be at liberty to renew the prayer for bail before the court below itself who shall pass order according to law.
