JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Ara Nawada P.S. Case No. 23 of 2019 registered for the offences punishable under Sections 385, 387, 34 of the Indian Penal Code and Section 37(ii) of Bihar Prohibition and Excise Act.

Prosecution story is that accused persons, including the petitioner came and on the point of pistol they demanded extortion from the informant, who is staff of clinic of Dr. Jitendra Kumar Singh and when the Doctor came they again demanded extortion and for that the matter was informed to the Superintendent of Police and then the present case has been lodged.

Submission of learned counsel for the petitioner is

Patna High Court CR. MISC. No.36783 of 2019(3) dt.16-08-2019 2/2 that he has falsely been implicated, having no criminal antecedent.

Heard learned APP, who has opposed the prayer for anticipatory bail of the petitioner.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail, which shall be considered on its own merit.

With the above observation, this application is dismissed.
