The petitioner apprehends his arrest in a case registered for the offence punishable u/s 323, 341, 498(A) and 506 of the IPC and sections 3⁄4 of the Dowry Prohibition Act. 3.

Allegedly, the petitioner along with other co-accused persons are said to have physically and mentally tortured the complainant for demand of dowry.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. Petitioner has

Patna High Court CR. MISC. No.43108 of 2023(2) dt.10-08-2023 2/2 neither made any dowry demand nor has ever tortured the complainant. Earlier the O.P. No.2 filed a divorce case in the Family Court of Bengaluru being M.C. No.1691 of 2020/Reg. No.1687 of 2020 and when the petitioner appeared in the divorce case, the O.P. No.2 withdrew the said divorce case on 11.10.2022. Thereafter, O.P. No.2 filed the present case in Bihar and then the petitioner has filed a divorce case in Bengaluru in the year, 2023. Petitioner has no criminal antecedent. 5.

Learned APP for the State as well as learned counsel for the O.P. No.2 opposed the prayer for bail.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Complaint Case No.1170(C) of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
