Heard learned counsel for the petitioner and the State through Video Conferencing.

Petitioner seeks regular bail in Shikarpur P.S. Case No. 431 of 2022 registered for the offences punishable under sections 419, 420, 467, 468, and 471 of the Indian Penal Code. As per the allegation, the petitioner applied for the post of constable in general category in Central Revenue Police and during the course of examination he appeared at the concerned examination center and filed the required document showing himself coming under general category and the said

Patna High Court CR. MISC. No.40667 of 2022(2) dt.14-10-2022 2/3 document was found forged after verification made by the concerned authority and the petitioner is alleged to have used the said forged document with an intention to get relaxation in his age.

The main submissions advanced by learned senior counsel Shri Krishna Prashad Singh appearing for the petitioner are that the petitioner bears clean antecedent and has been languishing in jail since 25.05.2022 and against him the investigation is completed and he had no knowledge about the alleged document being forged and he bonafidely submitted the said document before the recruitment agency and moreover, he is a young person.

Shri Mukesh Kumar Singh, learned APP appearing for the State has opposed the prayer for bail. In view of the above submissions and mainly taking into account the petitioner's clean antecedent and his custody period and also the fact that he is stated to be 20 years old person and against him investigation has been completed, in the opinion of this Court the petitioner deserves to a lenient approach of this Court.
