JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-328, 395, 397, 412 of the Indian Penal Code. Submission on behalf of the petitioner is that earlier the prayer for bail of the petitioner was rejected by a coordinate bench of this court as at that time, the case of the petitioner was at infancy stage but now, the circumstance has changed and the case is pending for prosecution evidence.

It is further submitted that as a matter of fact, the petitioner was caught only on the ground of suspicion and except cash and mobile, nothing has been recovered as it is evident from

Patna High Court Cr.Misc. No.34566 of 2016 (4) dt.18-11-2016 2/2 perusal of the seizure list.

Paragraph-3 of the petition goes to show that the petitioner was made accused in the present case as well as Bettiah Town P.S. Case No. 446 of 2015 and except the aforesaid case; the petitioner does not have any criminal antecedent and is languishing in jail custody since 18-07-2015. Considering the period of detention of the petitioner in jail custody as well as facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bettiah Muffasil (Manuapul) P.S. Case No. 404 of 2015 to the satisfaction of learned Chief Judicial Magistrate, West Champaran, Bettiah.
