In this application for anticipatory bail the petitioner apprehends his arrest for the offences punishable under sections 302/34 of the I.P.C.
Allegedly, the brother of the informant was found dead and it is alleged that the petitioner was having illicit relationship with Rupa Devi and the petitioner was caught and was assaulted by the villagers wherein the deceased was also there and at that time petitioner has caused threats and accordingly suspicion has been caused against the petitioner and co-accused. Submission is of false implication and that besides suspicion there is nothing. There is no direct evidence or
Patna High Court Cr.Misc. No.50561 of 2014 (2) dt.07-05-2015 2/2 circumstancial evidence against the petitioner and as such the petitioner deserves sympathetic consideration, to which the learned A.P.P. opposes.
In the facts and circumstances as stated above, considering that there is no eye witness of the occurrence, the petitioner in case of his arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of.
